Florida Lady Bird Deed Form: Required Elements, Signing, and Recording

Florida has no official lady bird deed form. The enhanced life estate deed is a creature of Florida practice rather than statute, which means the document’s language, not a state template, determines whether it works. Why There Is No Official Florida Lady Bird Deed Form

Lady bird deeds are not codified in Florida statute. No state agency publishes an approved template, and no statute prescribes required wording. The instrument is valid because Florida property law lets owners convey real estate in any lawful manner, because the deed satisfies the general execution and recording framework of F.S. 689.01 and F.S. 695.01, and because Florida title insurance companies accept properly drafted enhanced life estate deeds and insure title based on them.

That last point matters most in practice. When your beneficiary eventually sells or refinances, a title underwriter will read the deed. If the language does not meet the underwriter’s standards, the beneficiary can face title objections, demands for corrective work, or a quiet title action. A form is only as good as the title it produces.

What a Florida Lady Bird Deed Form Must Include

A properly drafted Florida enhanced life estate deed contains, at minimum:

• The grantor’s full legal name and marital status. Marital status drives the homestead analysis described below.
• The complete legal description of the property, exactly as it appears in the county official records. A street address is not a legal description, and an error here can cloud title.
• A reserved enhanced life estate. The deed must reserve a life estate to the grantor coupled with the enhanced powers that give the instrument its name.
• The enhanced powers clause. An express reservation of the grantor’s unrestricted right to sell, convey, mortgage, lease, and otherwise dispose of the property during life, and to revoke or change the remainder, all without the consent or joinder of the remainder beneficiaries. This clause is what separates a lady bird deed from a traditional life estate deed. If it is missing or incomplete, the grantor may need the beneficiaries’ signatures to sell or mortgage their own home.
• Named remainder beneficiaries, with language addressing what happens if a beneficiary dies before the grantor (to their descendants, to the surviving co-beneficiaries, or otherwise).
• Homestead status recitals where applicable, so the deed’s treatment of homestead is clear on its face.

Signing Requirements: Witnesses and Notarization

Under F.S. 689.01, a Florida deed must be signed by the grantor in the presence of two subscribing witnesses and acknowledged before a notary public. The witnesses must actually see the grantor sign (or receive the grantor’s acknowledgment of the signature) and must sign the deed themselves. Florida also permits online notarization and electronic witnessing when the statutory procedures are followed.

A deed that is notarized but lacks the two witnesses does not convey legal title in Florida. This is one of the most common execution defects in do-it-yourself deeds, because many national form sites are built around states that require only a notary.

Recording the Deed and What It Costs

The signed deed must be recorded in the official records of the county where the property is located, under F.S. 695.01. Recording gives the world notice of the deed and protects the beneficiaries’ remainder interest against later purchasers and creditors without notice.

Costs are modest. The clerk charges recording fees set by statute (currently in the range of ten dollars for the first page and a few dollars for each additional page; check the county clerk’s current fee schedule). Documentary stamp tax under F.S. 201.02 is generally the $0.70 minimum for a no-consideration family transfer, though an existing mortgage can change the calculation. Why Generic Internet Forms Fail in Florida

The homestead trap. Florida homestead property cannot be devised away from a surviving spouse, and additional restrictions apply when there are minor children, under F.S. 732.401 and Article X, Section 4 of the Florida Constitution. A lady bird deed on homestead that names someone other than the spouse while a spouse survives may be void, leaving the family with a title problem to fix in court. No generic national form asks the questions needed to catch this.

The missing or weak enhanced powers clause. Forms drafted for other states, or trimmed by non-lawyers, often reserve a plain life estate. The grantor then discovers at refinancing or sale that the bank wants every remainder beneficiary to sign.

Title insurer standards. Underwriters look for specific reservation language. A deed that a title company will not insure defeats the purpose of the instrument, because the beneficiary inherits a marketability problem instead of a clean title.

Medicaid planning language. When preserving Medicaid eligibility or limiting estate recovery exposure is part of the goal, the deed needs to be drafted and timed with those rules in mind. A form cannot exercise that judgment.
